Other data is automatically recorded by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time of the page call). This data is collected automatically as soon as you enter our website.

What are the purposes we use your data for?

A portion of the information is generated to guarantee the error free provision of the website. Other data may be used to analyze your user patterns.

What rights do you have as far as your information is concerned?

You have the right to receive information about the origin, recipient and purpose of your stored personal data free of charge at any time. You also have the right to request the correction, blocking or deletion of this data. You can contact us at any time at the address given in the imprint if you have any further questions on the subject of data protection. You also have the right to lodge a complaint with the competent supervisory authority.

In addition, you have the right to request the restriction of the processing of your personal data in certain circumstances. Details can be found in the privacy policy under "Right to restriction of processing".

You can object to this analysis or prevent it by not using certain tools. Detailed information about these tools and their possibilities of appeal can be found in the following privacy policy.

2. General information and mandatory information

Privacy

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration. If you use this website, various personal data will be collected. Personal data is data with which you can be personally identified. This data protection declaration explains what data we collect and what we use it for. It also explains how and for what purpose this happens. We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is not possible.

Information about the responsible party (referred to as the “controller” in the GDPR)

The data processing controller on this website is:

Hotel Gutenmorgen
Phone: (03 39 23) 702 75
E-mail: infohotel-gutenmorgen.de

The responsible body is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Revocation of your consent to the processing of data

Many data processing operations are only possible with your express consent. You can revoke consent that you have already given at any time. An informal message by e-mail to us is sufficient. The legality of the data processing that took place up until the revocation remains unaffected by the revocation.

Right to object to the collection of data in special cases; right to object to direct advertising (Art. 21 GDPR)

If the data is processed on the basis of Article 6 Paragraph 1 Letter e or f GDPR, you have the right at any time to object to the processing of your personal data for reasons that arise from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this data protection declaration. If you object, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims ( Objection according to Art. 21 Para. 1 GDPR).

If your personal data is processed in order to operate direct advertising, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising. If you object, your personal data will then no longer be used for direct advertising purposes (objection according to Art. 21 Para. 2 GDPR).

Right to log a complaint with the competent supervisory agency

In the event of violations of the GDPR, those affected have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy. A list of data protection officers and their contact details can be found at the following link: https://www.bfdi.bund.de/DE/Service/Anschriften/anschriften_node.html (Germany) and https://www.dsb.gv.at/ueber-die-website/kontakt.html (Austria).

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

SSL and/or TLS encryption

This site uses SSL or TLS encryption for security purposes and to protect the transmission of confidential content, such as orders or requests you send to us as a site operator. An encrypted connection is indicated by the browser's address bar changing from "http: //" to "https: //" and the lock icon in your browser bar.

If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.

Encrypted payment transactions

If, after the conclusion of a fee-based contract, there is an obligation to send us your payment data (e.g. account number for direct debit authorization), this data is required for payment processing. Payment transactions using the usual means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. With encrypted communication, your payment data that you transmit to us cannot be read by third parties.

Information, blocking, deletion and correction

Within the framework of the applicable legal provisions, you have the right to free information about your stored personal data, its origin and recipient and the purpose of the data processing and, if necessary, a right to correction, blocking or deletion of this data at any time. You can contact us at any time at the address given in the imprint if you have any further questions on the subject of personal data.

Right to demand processing restrictions

You have the right to request the restriction of the processing of your personal data. You can contact us at any time at the address given in the imprint. The right to restriction of processing exists in the following cases:

  • If you deny the accuracy of your personal information stored with us, we usually need time to verify this. For the duration of the audit you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data is unlawful, you may request the restriction of data processing instead of deletion.
  • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data instead of demanding the eradication of this data.
  • If we do not need your personal data any longer and you need it to exercise, defend or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its eradication.

If you have restricted the processing of your personal data, these data may be - except for their storage - only with your consent or for the assertion, exercise or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest the European Union or a Member State.

Opposition to promotional emails

We hereby expressly prohibit the use of contact data published in the context of website legal notice requirements with regard to sending promotional and informational materials not expressly requested. The website operator reserves the right to take specific legal action if unsolicited advertising material, such as email spam, is received.

3. Data collection on our website

Cookies

Some of our web pages use cookies. Cookies do not harm your computer and do not contain any viruses. Cookies help make our website more user-friendly, efficient, and secure. Cookies are small text files that are stored on your computer and saved by your browser.

Most of the cookies we use are so-called "session cookies". They are automatically deleted after your visit. Other cookies remain stored on your device until you delete them. These cookies allow us to recognize your browser the next time you visit.

You can configure your browser to inform you about the use of cookies so that you can decide on a case-by-case basis whether to accept or reject a cookie. Alternatively, your browser can be configured to automatically accept cookies under certain conditions or to always reject them, or to automatically delete cookies when closing your browser. Disabling cookies may limit the functionality of this website.

Cookies that are required to carry out the electronic communication process or to provide certain functions you want (e.g. shopping cart function) are stored on the basis of Art. 6 Para. 1 lit. f GDPR. The website operator has a legitimate interest in the storage of cookies for the technically error-free and optimized provision of its services. Insofar as other cookies (e.g. cookies for analyzing your surfing behavior) are stored, these are treated separately in this data protection declaration.

Server log files

The website provider automatically collects and stores information that your browser automatically transmits to us in "server log files". These are:

  • The type and version of browser used
  • The used operating system
  • Referrer URL
  • The hostname of the accessing computer
  • The time of the server inquiry
  • The IP address

A merge of this data with other data sources will not be done. The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and the optimization of his website - for this purpose, the server log files must be recorded.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent. The processing of the data entered in the contact form is therefore exclusively based on your consent (Article 6 (1) (a) GDPR). You can revoke this consent at any time. An informal message by e-mail to us is sufficient. The legality of the data processing operations that took place up until the revocation remains unaffected by the revocation. The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular retention periods - remain unaffected.

Request by e-mail, telephone, or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b DSGVO, if your request is related to the performance of a contract or is required to carry out pre-contractual action. In all other cases, the processing is based on your consent (Article 6 para. 1 lit. a DSGVO) and / or on our legitimate interests (Art. 6 para. 1 lit. f DSGVO), as we have a legitimate interest in the effective Processing of requests addressed to us.

The data you send to us via contact requests will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Registration on this site

You can register on our website to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise we will refuse the registration.

To inform you about important changes such as those within the scope of our site or technical changes, we will use the email address specified during registration.

The data entered during registration is processed on the basis of your consent (Article 6 (1) (a) GDPR). You can revoke any consent you have given at any time. An informal message by e-mail to us is sufficient. The legality of the data processing that has already taken place remains unaffected by the revocation.

The data collected during registration will be stored by us as long as you are registered on our website and will then be deleted. Statutory retention periods remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only insofar as they are necessary for the establishment, content or change of the legal relationship (inventory data). This is based on Article 6 Paragraph 1 Letter b GDPR, which allows the processing of data to fulfill a contract or pre-contractual measures. We collect, process and use personal data about the use of our website (usage data) only to the extent necessary to enable the user to use the service or to bill the user.

Collected customer data shall be deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.

Data transmitted when entering into a contract with online shops, retailers, and mail order

We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract, for example, to companies entrusted to deliver goods to your location or banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent.

The basis for the processing of data is Art. 6(1)(b) GDPR, which permits the processing of data for the fulfilment of a contract or for pre-contractual actions.

Data transfer upon closing of contracts for services and digital content

We only transfer personal data to third parties if this is necessary in the context of contract processing, for example to the credit institution commissioned with the payment processing. A further transmission of the data does not take place or only if you have expressly consented to the transmission. Your data will not be passed on to third parties without express consent, for example for advertising purposes. The basis for data processing is Art. 6 Para. 1 lit. b GDPR, which allows the processing of data to fulfill a contract or pre-contractual measures.

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider of this service is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.

IP anonymization

We have activated the IP anonymization function on this website. As a result, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before it is transmitted to the USA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plug-in

You can prevent these cookies being stored by selecting the appropriate settings in your browser. However, we wish to point out that doing so may mean you will not be able to enjoy the full functionality of this website. You can also prevent the data generated by cookies about your use of the website (incl. your IP address) from being passed to Google, and the processing of these data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

Data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Demographic data collection by Google Analytics

This website uses the demographics feature of Google Analytics. As a result, reports can be produced that contain statements on the age, gender and interests of the site visitors. This data comes from interest-based advertising from Google and third-party visitor data. This data can not be assigned to a specific person. You can disable this feature at any time through the ad settings in your Google Account, or generally prohibit the collection of your data by Google Analytics as outlined in the section "Opposition to Data Collection".

Retention period

Data stored by Google at user and event level that are linked to cookies, user IDs (e.g. user ID) or advertising IDs (e.g. DoubleClick cookies, Android advertising ID) are anonymized after 14 months or deleted. You can find details on this under the following link: https://support.google.com/analytics/answer/7667196?hl=de

Google Analytics Remarketing

Our websites use the functions of Google Analytics Remarketing in connection with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

This function makes it possible to link the advertising target groups created with Google Analytics Remarketing with the cross-device functions of Google AdWords and Google DoubleClick. In this way, interest-based, personalized advertising messages that have been adapted to you depending on your previous usage and surfing behavior on one device (e.g. mobile phone) can also be displayed on another of your devices (e.g. tablet or PC).

Once you have given your consent, Google will associate your web and app browsing history with your Google Account for this purpose. That way, any device that signs in to your Google Account can use the same personalized promotional messaging.

To support this feature, Google Analytics collects Google-authenticated IDs of users that are temporarily linked to our Google Analytics data to define and create audiences for cross-device ad promotion.

You can permanently object to cross-device remarketing / targeting by deactivating personalized advertising; follow this link: https://adssettings.google.com/.

The aggregation of the recorded data in your Google account takes place exclusively on the basis of your consent, which you can give to Google or revoke (Art. 6 Para. 1 lit. a GDPR). In the case of data collection processes that are not merged in your Google account (e.g. because you do not have a Google account or have objected to the merging), the collection of data is based on Art. 6 Para. 1 lit. f GDPR. The legitimate interest arises from the fact that the website operator has an interest in the anonymised analysis of the website visitors for advertising purposes.

Google AdSense also uses so-called web beacons (invisible graphics). These web beacons can be used to evaluate information such as visitor traffic on these pages. The information generated by cookies and web beacons about the use of this website (including your IP address) and the delivery of advertising formats is transmitted to a Google server in the USA and stored there. This information may be passed on by Google to Google's contractual partners. However, Google will not merge your IP address with other data stored by you. AdSense cookies are stored on the basis of Article 6 (1) (f) GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising. You can prevent the installation of cookies by setting your browser software accordingly; we would like to point out to you however that in this case you can if applicable not use all functions of this website in full. Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising program of Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

As part of Google AdWords, we use so-called conversion tracking. When you click on an ad served by Google, a conversion tracking cookie is set. Cookies are small text files that your internet browser stores on your computer. These cookies expire after 30 days and are not used for personal identification of the user. Should the user visit certain pages of the website and the cookie has not yet expired, Google and the website can tell that the user clicked on the ad and proceeded to that page.

Each Google AdWords advertiser has a different cookie. Thus, cookies cannot be tracked using the website of an AdWords advertiser. The information obtained using the conversion cookie is used to create conversion statistics for the AdWords advertisers who have opted for conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, advertisers do not obtain any information that can be used to personally identify users. If you do not want to participate in tracking, you can opt-out of this by easily disabling the Google Conversion Tracking cookie by changing your browser settings. In doing so, you will not be included in the conversion tracking statistics.

The storage of "conversion cookies" and the use of this tracking tool are based on Article 6 Paragraph 1 lit. f GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising.
